32 Sleeps is an Australian sole-trader business operating under ABN 66 175 057 230.
In these terms, “32 Sleeps”, “we”, “us” and “our” refer to the business operating under that ABN.
“You” and “your” refer to a website visitor, customer or subscriber.
1. Agreement to These Terms
These Terms of Service govern your access to and use of the 32 Sleeps website and your purchase of products from us.
By accessing the website, creating an account, placing an order or purchasing a subscription, you agree to these terms.
Our Privacy Policy, Refund and Returns Policy, Shipping Policy and any product-specific terms or warnings displayed on the website form part of these terms.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
2. Eligibility
You must be at least 18 years old to:
- place an order;
- create a paid subscription; or
- provide payment authority.
By placing an order, you confirm that you have the legal capacity and authority to enter into the transaction.
Individual products may have separate suitability, safety or age restrictions.
3. Website Information
We take reasonable steps to ensure that the information displayed on our website is accurate and current.
However:
- product colours may appear differently depending on your screen;
- packaging and labels may change;
- photographs may be illustrative;
- minor product variations may occur; and
- website information may occasionally contain an error.
Nothing in this section allows us to provide misleading or materially inaccurate information or limits your rights under the Australian Consumer Law.
4. Product Availability
All products are subject to availability.
Adding a product to your cart does not reserve that product.
Products marked “Coming Soon” are displayed for information or waitlist purposes only and cannot be purchased until they are formally released for sale.
We may reasonably limit product quantities, including where necessary to manage inventory or prevent suspected fraud or unauthorised resale.
5. Orders
When you submit an order, you make an offer to purchase the selected products under these terms.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been finally accepted.
We may decline or cancel all or part of an order before dispatch where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or product-description error;
- payment is declined or reversed;
- fraud or unauthorised use is reasonably suspected;
- required information cannot be verified;
- delivery is unavailable to the supplied address;
- the order breaches a product restriction; or
- fulfilment is prevented by circumstances outside our reasonable control.
Where we cancel a paid order, the relevant amount will be refunded unless payment is subject to a lawful fraud investigation, chargeback or other legal restriction.
6. Customer Information
You must provide accurate and complete:
- contact information;
- billing information;
- delivery information; and
- any other information reasonably required to process your order.
You are responsible for checking your delivery address before submitting an order.
Contact us promptly if any information is incorrect. We cannot guarantee that information can be changed after packing or fulfilment has begun.
Reasonable carrier, redelivery or return costs caused by an incorrect or incomplete address supplied by you may be charged to you.
7. Prices and Currency
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars.
Shipping charges and the final order total will be displayed before checkout is completed.
Prices may change before an order is submitted.
A price change will not ordinarily affect an order that has already been accepted, except where there is an obvious pricing error and correction is permitted by law.
International customers may be responsible for customs duties, import taxes, brokerage fees or other charges imposed by the destination country. These charges are not collected by 32 Sleeps unless expressly shown at checkout.
8. Payment
Available payment methods are displayed at checkout and may include:
- credit or debit card;
- Shopify Payments;
- Shop Pay;
- Apple Pay;
- Google Pay;
- PayPal; or
- other payment services made available through the website.
By submitting payment details, you confirm that:
- you are authorised to use the selected payment method;
- the information supplied is accurate; and
- sufficient funds or credit are available.
Payment services are operated by third parties and may be subject to their own terms and privacy policies.
We do not ordinarily receive or store complete payment-card details.
9. Fraud Prevention
We may conduct reasonable checks to prevent fraud, unauthorised transactions and misuse of the website.
We may request additional information where reasonably necessary to verify an order.
An order may be delayed or cancelled if verification cannot be completed.
Any information collected for this purpose will be handled in accordance with our Privacy Policy.
10. Shipping and Delivery
Orders are generally processed within 3–5 business days.
Processing time is separate from delivery time.
Estimated delivery after dispatch is typically:
- Australia: 3–10 business days
- International: 7–20 business days
Delivery timeframes are estimates only and are not guaranteed delivery dates.
Delivery may be affected by carrier delays, customs processing, public holidays, severe weather, border restrictions, remote locations or other circumstances outside our reasonable control.

11. Australian Shipping Charges
Standard shipping within Australia is charged at a flat rate of AUD $11.95.
Free standard Australian shipping applies where the qualifying order subtotal exceeds AUD $120, calculated after discounts and before shipping charges.
A different delivery charge may apply to unusually large, heavy, restricted or remote-area shipments where that charge is clearly displayed before checkout is completed.
12. International Shipping
We ship only to countries and regions made available at checkout.
International shipping charges are calculated or displayed at checkout according to the destination, parcel details and available delivery service.
You are responsible for checking whether a product may lawfully be imported, possessed and used in the destination country.
Unless checkout expressly states otherwise, the recipient is responsible for:
- customs duties;
- import taxes;
- brokerage fees; and
- other destination-country charges.
If a parcel is refused because import charges are not paid, it may be returned, abandoned or destroyed.
Any refund will be assessed according to the circumstances, costs incurred and applicable law.
13. Dispatch and Tracking
Where tracking is available, tracking details will be sent to the email address or contact details supplied with your order.
Carrier tracking information may not update immediately after dispatch.
Contact us if a parcel is materially overdue. We may ask you to assist with a carrier investigation.
Nothing in this section limits any legal responsibility that remains with us as the seller.
14. Order Cancellations
You may request cancellation before dispatch by contacting:

We will make reasonable efforts to accommodate your request, but cancellation is not guaranteed once packing, fulfilment or dispatch processing has commenced.
Where an order has already been dispatched, it will generally need to be handled under our Refund and Returns Policy.
15. Returns, Refunds and Consumer Guarantees
Returns, refunds, exchanges and remedies are governed by our Refund and Returns Policy and the Australian Consumer Law.
Our voluntary change-of-mind return policy does not replace or limit statutory consumer rights.
16. General Product Safety
Products must be used:
- only for their intended purpose;
- in accordance with the product label;
- in accordance with supplied instructions and warnings; and
- only by persons for whom the product is reasonably suitable.
Read all product information before use.
Stop using a product and seek appropriate advice if you experience:
- breathing difficulty;
- a significant skin reaction;
- an allergic reaction;
- pain or discomfort; or
- another concerning symptom.
Information provided through our website, emails, social media, journal or other educational materials is general information only.
It is not personal medical advice, diagnosis or treatment and is not a substitute for advice from a suitably qualified health professional.
Unless a product is expressly and lawfully represented otherwise, it is not intended to diagnose, treat, cure or prevent any disease or medical condition.
Seek professional advice before using a relevant product where you:
- have a medical condition;
- have a diagnosed or suspected sleep or breathing disorder;
- take medication;
- are pregnant or breastfeeding;
- have allergies or sensitive skin; or
- are unsure whether a product is suitable for you.
17. Mouth Tape
Mouth tape must not be used by anyone under 16 years old.
A person under 18 years old must not purchase mouth tape directly through the website.
Mouth tape must not be used contrary to the instructions or warnings supplied with the product.
Do not use mouth tape if you:
- cannot breathe comfortably through your nose;
- are unable to remove the tape independently;
- have significant nasal congestion or obstruction;
- have a diagnosed or suspected breathing disorder unless appropriately advised by a qualified health professional;
- are at risk of vomiting;
- have consumed alcohol, sedatives or intoxicating substances in circumstances that may affect safe use;
- have broken, irritated or unsuitable skin around the mouth; or
- have been advised by a health professional not to use it.
Stop using the product immediately if breathing becomes difficult or an adverse reaction occurs.
The manufacturer’s product-specific instructions and warnings apply and take priority where they impose stricter requirements.
18. Supplements and Ingestible Products
Supplements and other ingestible products must be used according to:
- the product label;
- stated dosage directions;
- allergen information;
- storage directions;
- expiry information; and
- product warnings.
Do not exceed the stated dosage.
Keep ingestible products out of reach of children.
Seek professional advice before use if you:
- have a medical condition;
- take medication;
- are pregnant or breastfeeding;
- have known allergies; or
- are uncertain whether the product is suitable for you.
Product claims will be limited to claims that may lawfully be made in Australia.
19. Resold Products
Some products may be manufactured, imported, sponsored or supplied by third parties and resold by 32 Sleeps.
The relevant brand, manufacturer, sponsor or supplier may be identified on the product packaging or product page.
Our status as a reseller does not exclude or reduce your rights against us as the retailer.
Any manufacturer warranty is provided in addition to rights under the Australian Consumer Law.
20. Subscriptions
Selected products may be offered on a recurring subscription basis.
Before a customer starts a subscription, the product page or checkout will display:
- the recurring price;
- billing frequency;
- delivery frequency;
- applicable discount; and
- any shipping charges.
By purchasing a subscription, you authorise 32 Sleeps and its payment-processing providers to charge the selected payment method automatically at the recurring interval shown at checkout.
A subscription continues until it is cancelled.
You may request cancellation by contacting:

Cancellation applies to future subscription orders that have not already been charged.
If payment for the next subscription order has already been processed, that order may proceed and cancellation will apply from the following billing cycle.
We recommend submitting cancellation requests at least five business days before the next scheduled billing date to allow time for processing.
Cancelling a subscription does not automatically cancel or refund an order that has already been charged, packed or dispatched.
This does not affect any rights available under the Australian Consumer Law.
You are responsible for keeping your payment and delivery information current.
If a recurring payment cannot be processed, the subscription may be delayed, suspended or cancelled.
We may change a subscription price by giving at least 14 days’ notice before the increased amount is charged. You may cancel before the next billing date if you do not accept the new price.
We may modify or discontinue a subscription offering on reasonable notice. Any product already paid for but not supplied will be handled in accordance with applicable law.
21. Customer Accounts
Where customer accounts are available, you are responsible for:
- keeping your login information secure;
- maintaining accurate account information;
- preventing unauthorised access; and
- notifying us of suspected unauthorised activity.
We may reasonably suspend or restrict an account where necessary to protect a customer, the website or the business.
22. Reviews and Customer Content
If you submit a review, photograph, comment, testimonial or other content, you confirm that:
- you created it or have permission to submit it;
- it is accurate to the best of your knowledge;
- it does not infringe another person’s rights;
- it is not unlawful, abusive or misleading; and
- it does not disclose another person’s confidential information.
You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use the submitted content for operating and promoting 32 Sleeps.
We will not use an identifiable personal photograph in paid advertising without additional permission where consent is reasonably required.
We may remove content that is unlawful, fraudulent, abusive, irrelevant or infringes another person’s rights.
We will not remove a genuine review merely because it is negative.
23. Intellectual Property
The website and its original content, including:
- the 32 Sleeps name and branding;
- text;
- designs;
- graphics;
- photographs;
- journal materials;
- product descriptions; and
- website layout
are owned by or licensed to 32 Sleeps.
You may access the website for personal and non-commercial use.
Without prior written permission, you must not:
- reproduce substantial website content;
- commercially exploit our materials;
- remove ownership or copyright notices;
- use our branding in a misleading manner; or
- falsely imply an association with 32 Sleeps.
Third-party names, product names and trademarks remain the property of their respective owners.
24. Prohibited Use
You must not use the website to:
- breach any applicable law;
- commit or facilitate fraud;
- introduce viruses, malware or harmful code;
- interfere with website security or operation;
- attempt unauthorised access to an account or system;
- use unreasonable automated scraping or data-extraction methods;
- impersonate another person;
- infringe intellectual-property or privacy rights;
- provide false payment or delivery information;
- submit unlawful, abusive or misleading content; or
- send unsolicited commercial communications through the website.
We may restrict access, suspend an account or cancel an affected order where reasonably necessary and permitted by law.
25. Third-Party Services and Links
Our website may use or link to services provided by Shopify, payment providers, delivery providers, social-media platforms and other third parties.
Those services may be governed by separate terms and privacy policies.
We do not control independent third parties and are not responsible for their content or conduct, except to the extent that responsibility cannot legally be excluded.
26. Website Availability
We do not guarantee that the website will always be uninterrupted, error-free or available.
We may perform maintenance, correct errors or alter website functions.
This does not affect accepted orders or any rights available under consumer law.
27. Limitation of Liability
Nothing in these terms excludes, restricts or modifies:
- the Australian Consumer Law;
- liability for fraud or wilful misconduct;
- liability that cannot legally be excluded; or
- any non-excludable right, guarantee or remedy.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable or that arose from circumstances outside our reasonable control.
Any limitation in these terms will apply only to the extent that it is legally enforceable.
28. Events Outside Our Reasonable Control
We are not responsible for delays caused by circumstances outside our reasonable control, including:
- severe weather;
- natural disasters;
- carrier disruption;
- customs delays;
- industrial action;
- supply-chain interruption;
- government restrictions;
- border closures;
- cyber incidents; or
- failure of third-party infrastructure.
We will take reasonable steps to reduce disruption and comply with any obligations that continue to apply under law.
29. Changes to These Terms
We may update these terms from time to time.
The updated version will apply from the effective date displayed on the website.
Material changes affecting active subscriptions will be communicated on reasonable notice, ordinarily at least 14 days before taking effect.
Changes will not retrospectively remove accrued consumer rights.
30. Severability
If any provision of these terms is invalid or unenforceable, it will be read down or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
31. No Waiver
A failure or delay in exercising a right does not waive that right.
32. Transfer of Business
You may not transfer your customer account or contractual rights without our consent.
We may transfer these terms as part of a legitimate sale, transfer or restructure of the business, subject to applicable law and our Privacy Policy.
33. Governing Law
These terms are governed by the laws of Queensland, Australia.
The parties submit to the courts of Queensland and applicable Australian courts.
Nothing in this section prevents a consumer from exercising a right to bring a claim in another jurisdiction where that right cannot legally be excluded.
